"Section 1 of the Fraud Act 2006 establishes a general offence of fraud, which can be committed in three ways: fraud by false representation (section 2), fraud by failing to disclose information (section 3), or fraud by abuse of position (section 4). A person is guilty of fraud if they are in breach of any of these sections. The offence is based on the defendant's dishonest conduct and their intention to make a gain for themselves or another, to cause loss to another, or to expose another to a risk of loss. Notably, no actual gain or loss needs to have occurred for the offence to be committed; the focus is on the conduct itself."
