Looks like SEC just approved in-kind creation / redemption for all spot bitcoin and ether ETFs. In the U.S., in-kind redemptions are generally considered non-taxable events for the ETF itself. When an AP redeems ETF shares for Bitcoin or Ether, the ETF transfers the underlying cryptocurrency without selling it, avoiding a capital gains tax event within the fund.
