At the Supreme Court oral arguments for a case brought by two trans-identifying males who want to play on female sports teams but were barred in conservative-controlled states Idaho and West Virginia, the lawyer for Idaho argued to the justices: βIdahoβs law classifies on the basis of sex, because sex is what matters in sports, it correlates strongly with countless athletic advantages, like size, muscle mass, bone mass and heart and lung capacity.β The ACLU and Democrat attorneys for the two males argue that sex shouldnβt be legally defined and that this is illegal gender discrimination.
