The IDF says it targeted a Terrorist Command Center in an airstrike outside of the Al Aqsa Hospital in Gaza.
4 deaths and 40+ injured
| Analysis |
Secondary explosions can be seen following the airstrike. What sounds like bullets exploding can be heard in several videos of the tents burning. There is no doubt munitions were being stored at this location.
There is also no doubt civilians were in the area. One video shows what appears to be a hospital patient with IV tubs still attached to his arm in the fires. Former hospital staff stated patient overflow was often sent into this area.
This raises multiple questions:
1. Were the civilians aware of Hamas's location?
2. Were hospital staff aware of Hamas's location?
3. Was this legal?
Answer:
Were the civilians aware of Hamas's location?
It is highly unlikely civilians were unaware of Hamas operations inside this tented area. While possible, it is highly improbable civilians were unaware given the close living situation.
Were hospital staff aware of Hamas's location?
This also means hospital staff were likely alerted to Hamas's presence via concerned civilians, yet nothing happened. At least that we know of. Human intelligence could have played a factor in Israel's targeting of the site.
Was this legal?
That depends. In order to answer it honestly, we would need access to the target package showing the intelligence on the objective.
What munition did the IDF use? What was the actual target (rank of Hamas members, munitions stored, etc)? What was the assessed risk of NOT conducting this strike on IDF troops and Israeli civilians?
After reviewing the footage, no doubt there was a valid military target present.
